CITY COUNCIL MEETING

Mayor Fridal called the October 16, 2018 City Council Meeting to order at 7:00 p.m. The meeting was held in the Tremonton City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Those in attendance were Mayor Fridal, Councilmembers Doutre, Holmgren, Reese, and Vance, City Manager Warnke, and City Recorder Nessen. The following Department Heads were also present: Public Works Director Paul Fulgham, and Police Chief Kurt Fertig.

1. Opening Ceremony:

Mayor Fridal said a group of scouts had requested to participate in the Opening Ceremony. He asked anyone who may be offended by listening to a prayer to step out into the lobby for this portion of the meeting. The prayer was offered by scout Aiden Robertson and the Pledge of Allegiance was led by scout Logan Lee.

2. Introduction of guests:

Mayor Fridal welcomed those in attendance, including a group of scouts.

3. Approval of Agenda:

Motion by Councilmember Holmgren to approve the agenda of October 16, 2018 with item 5. a. pushed to the next meeting. Motion seconded by Councilmember Vance. Vote: Councilmember Doutre – aye, Councilmember Holmgren – aye, Councilmember Reese – aye, Councilmember Vance – aye. Motion approved.

4. Approval of minutes – October 2, 2018

Motion by Councilmember Doutre to approve the minutes of October 2, 2018. Motion seconded by Councilmember Reese. Vote: Councilmember Doutre – aye, Councilmember Holmgren – aye, Councilmember Reese – aye, Councilmember Vance – aye. Motion approved.

5. Years of service award

a. Josh Kearl, Police Officer – 5 Years

This item was pushed until the next meeting, which will be November 6.

6. Public comments: This is an opportunity to address the City Council regarding your concerns or ideas. Please limit your comments to three minutes.

Scout Aiden Robertson wondered if they could help push strawberry milk instead of chocolate milk in the schools, while scout Jackson Liechty suggested having Parks and Recreation football and baseball leagues extended to older grades.

7. New Council Business:

a. Discussion and consideration of adopting Resolution No. 18-47 approving a land use acquisition agreement between Tremonton City and Jesse F. Courter & Mary M. Courter for the purpose of acquiring right-of-way for the continuation of the 950 East collector road north of Main Street

Manager Warnke said there are two agreements for consideration. One is with the Courters and one is with the Fridals. Manager Warnke has talked to Jesse Courter who has read the agreement and worked with Knud Fridal and believe everything is in order there as well, though he has not been able to contact him. The last communication we had we were waiting for a formal appraisal to be done. In the past, we had agreed on $19,000, but were able to secure Corridor Preservation Funds though the Mayors’ Association meeting. That will deliver the appraised amount ($21,100) to the property owner, which included compensation for grain bins and the property. We just need to finalize that with him, but all the conversations leading up to that have been positive. Manager Warnke showed the Council a breakdown of what he filled out the Corridor Preservation Funds application for. He said at the time, we knew what Jesse Courter’s property was going to be ($37,000) from a previous appraisal. We budgeted $25,000 for Knud Fridal’s piece and it came in at $21,100. We also budgeted money for professional fees, which will be $8,000 to $9,000. The County will cover this 100%. The County and Mayors’ Association have been great. We got all the partial releases off of Jesse Courter’s property and the bank authorized the release of a portion of the property that they have a trust deed on. All the documents are in Jenny Goring’s possession with the title company. The terms are finalized with Jesse Courter. With Knud Fridal, we believe everything is in order, but if there are some minor modifications that do not affect the cost, would the Council allow me to make those amendments so we can close? Otherwise, we would have to wait three weeks before we could close on the properties. Jesse Courter approved it, but I have not had the same affirmation from Knud Fridal. The appraised amount includes the grain bins. The first appraisal came in at $18,500. Knud Fridal was concerned about labor so we visited with the appraiser and he came back with an adjusted value of $21,100. This included the labor, which was relative to the original construction. There is a depreciative amount of 35%. Since we are purchasing the property in which the bins are on, we would then own them. We are also working with the developer on a cost sharing agreement (50/50) to install the entrance and first portion of the road.

Motion by Councilmember Reese to adopt the resolution. Motion seconded by Councilmember Vance. Roll Call Vote: Councilmember Doutre – aye, Councilmember Holmgren – aye, Councilmember Reese – aye, Councilmember Vance – aye. Motion approved.

b. Discussion and consideration of adopting Resolution No. 18-48 approving a land use acquisition agreement between Tremonton City and Knud H. Fridal IV & Connie R. Fridal for the purpose of acquiring right-of-way for the continuation of the 950 East collector road north of Main Street

Motion by Councilmember Holmgren to adopt the resolution. Motion seconded by Councilmember Doutre. Roll Call Vote: Councilmember Doutre – aye, Councilmember Holmgren – aye, Councilmember Reese – aye, Councilmember Vance – aye. Motion approved.

The Holiday Open House for employees, past and present, will be held on Tuesday, November 20, at 2 p.m. until 5 p.m. The City Council’s Holiday get-together will be at its usual place at 6 p.m. on December 13.

1. Preliminary Review of lot split; amend River Valley, Phase 2 Lots 22 and 23; and amend River Valley, Phase 6 Lot 160 – Matt Nielson, Sierra Homes

Manager Warnke said this will be on the Development Review Committee agenda tomorrow and should make its way to the Council. It is a recorded lot and for financing purposes they wanted to split it into two different lots so the bank will feel more secure. There is not a density increase. Two four-plexes were slated to go on one lot and now there would be one four-plex building on each lot. Councilmember Reese said that is cleaner.

c. City Department Head Reports and Comments

Director Fulgham said each month I send out a report on water and wastewater for the month. We read the master meters feeding into town each Friday. This September was a four-week month, but we used more water in September than any other September in the past history with a four-week month. It has been hot and we have not had rain. The Governor declared a state of emergency because of the drought and six counties, including Box Elder, have done that. As this secondary water project comes to completion, it will take 150 to 200 connections off our culinary system by next spring. Last year we sold 79 single-family building permits and two four-plex permits. This year so far we have sold 67 single-family and five multi-family four-plexes and four commercials. One of the commercials uses a lot of outdoor water—Warner Truck Center and Stokes Trucking—because they have a lot of grass. Councilmember Reese wondered if they would be on the system soon. Director Fulgham said not in this phase, but in a future phase. If we can stay on that kind of growth, that as homes come on we can pull some of the old ones off, then that will help keep us above that curve. I do have some fear for next summer because we had such a dry year and our springs are about 10 months behind showing stress. We made it through this summer great, but we need to be aware that if we do not get moisture, we might have a struggle next summer. Councilmember Reese said if the springs are weak, we need to do restrictions sooner. Director Fulgham said we would start earlier in the year. If you have questions on that information be sure to contact me. I show the secondary use and what we are producing in our culinary sources and throw in the wastewater.

Councilmember Holmgren asked how measuring the canal for quality and the output at the plant is going. Director Fulgham said each week I measure E.coli counts in all three canals. Those range from 22 to 80 colonies per hundred-mil sample. If you compare it to what we are putting into the river, usually our treatment plant runs five to 20. We have a permit for up to 157 colonies per day and an average of 126 per month. Councilmember Reese said so we are proving our water is cleaner than what is in the canal. Director Fulgham said yes and I have all the data. I will send it to the Council and we will get a meeting with the new Canal Company manager and bring him up to speed. If they do not allow us to do this, then we could take that water to one of our zones and re-pressurize it back into our system, but it would be easier to swap with canal water in and out. Councilmember Vance asked if it is getting too cold to tar the road. Director Fulgham said yes, they are getting the service connections made and have already done the pressure tests. They will patch the small, narrow cuts—they just need to keep the heat up while it is compacted.
