Chairman Bench called the Land Use Authority Board Meeting to order at 9:02 a.m. The meeting was held January 20, 2016 in the City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Chairman Steve Bench, Engineer Chris Breinholt, Manager Shawn Warnke, Director Paul Fulgham, Director Marc Christensen, and Deputy Recorder Linsey Nessen were in attendance.

1. Approval of agenda:

Motion by Director Fulgham to approve the January 20, 2016 agenda. Motion seconded by Manager Warnke. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Manager Warnke – aye, Director Fulgham – aye, and Director Christensen – aye. Motion approved.

2. Approval of minutes: January 6, 2016

Motion by Director Fulgham to approve the minutes of January 6, 2016. Motion seconded by Director Christensen. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Manager Warnke – aye, Director Fulgham – aye, and Director Christensen – aye. Motion approved.

3. New Business:

a. Discussion of acquiring right-of-way for future road – Chris Sorensen

Manager Warnke stated he has reviewed the annexation and compared it to the City’s land uses. There is a proposed collector road that is in line with the west boundary of the annexation. The road alignment can vary based on the needs of the development, but the City needs a collector road in that area going north and south. Engineer Breinholt clarified the road Manager Warnke is speaking of is just a local road, which doesn’t require any more right-of-way. Engineer Breinholt stated he thought there was a collector road planned to run in front of the new school and stated the City will need to look at the recorded plat to figure out which road should be the collector road.

Engineer Breinholt stated the difference in a local street (60 foot right-of-way) and a collector road (66 foot right-of-way) is only six extra feet to allow for people to pull over, park, and get out of their vehicles without impeding traffic. Mr. Jim Christensen asked what is existing. Engineer Breinholt stated that is what the City needs to find out. Manager Warnke stated the City can verify on the existing plat if there is an existing collector road and let Mr. Sorensen and Mr. Christensen know, but what is envisioned is the need for that larger right-of-way to get traffic in and out of the subdivision especially if there is a school.

Mr. Sorensen asked if bringing the roads around to the other collector road in the development would work. Manager Warnke stated the City needs to verify that the road is actually a collector road and has that extra width. If there is a collector road in the development already, it would probably be adequate. If not, the City envisions the road in front of the school becoming a collector road in the future. The road would go straight over the canal and tie into the property to the north.

Mr. Christensen stated one of Mr. Sorensen’s concerns is maintaining the irrigation right-of-way through the development as well. The School District’s concern is Mr. Sorensen losing potential revenue from property that he could develop. They need to make sure that collector road that has to be wider doesn’t run between the right-of-way he has to maintain for the irrigation and needs to be considered in his concept plan. Manager Warnke stated there are a couple different ways to do collector roads; it could be split on the property line if both developers are going to be developing in a short time frame, or the road is moved onto one developer’s property and made sure lots can be added on both sides of the road, which doesn’t sound like an option that would work in this situation because of the canal. Mr. Sorensen stated the west side of this property is going to be tricky and may push the road more onto the School District’s property.

Mr. Sorensen asked where the road will go once it crosses the canal. Manager Warnke stated it will tie into 1000 North. Director Fulgham stated the road will have to be engineered with some grade work done to get it up to 1000 North. Engineer Breinholt stated he isn’t so concerned where the collector road is in the development so long as there is a collector road that ties into 1000 North.

Manager Warnke stated instead of crossing the canal with another collector road, the City would need a stub to provide good traffic circulation through the subdivision. Engineer Breinholt stated there also needs to be good circulation around the school back to the collector road. Chairman Bench stated the plans currently show all the roads tying back into the collector road. Mr. Sorensen stated that 450 North is the street that needs to be stubbed. Engineer Breinholt agreed and stated there will need to be one more street stubbed as well. Mr. Christensen stated they would rather move the collector road away from the school zone rather than deliberately adding more traffic to go through the school zone.

Manager Warnke asked about the size of the ditches on the property. Mr. Sorensen stated there are two small open irrigation ditches. Chairman Bench stated when the road goes in, if Mr. Sorensen is still using the ditches, he could pipe them. Mr. Sorensen stated he could pipe the ditches, but asked if those ditches could go in a roadway. Director Fulgham stated piped ditches can go under a roadway. Mr. Sorensen stated the ditches are on the very west side of his property and will almost be in people’s backyards and would rather have them moved into a roadway if possible. Chairman Bench stated if the land is developed into a subdivision, the ditches would be required to be piped at that point anyway.

Manager Warnke stated the City would like to have an Annexation Agreement in place so there is a general understanding of what is expected as it relates to the roads. The draft language will be emailed to Mr. Christensen and Mr. Sorensen to provide comments.

b. Discussion of an RV Park at the Box Elder County Fairgrounds

Manager Warnke asked if the County has spoke with Rocky Mountain Power about this project. County Commissioner Stan Summers stated Rocky Mountain Power is going to be coming to talk with them.

Commissioner Summers stated he proposed this idea to the Shoshone Tribe, who would like to take on this project. They would pay for the project and lease the ground from the County. Manager Warnke clarified this would be an RV Park, which would be more transient. Commissioner Summers agreed and stated the County has some funds that could be used to pay the City’s Impact Fees and help with curb, gutter, road, and necessary connections. Chairman Bench asked if this RV Park would be open to anyone to use. Commissioner Summers stated it would be open for anyone to use. Commissioner Summers clarified the road needs to be expanded. Manager Warnke agreed.

Manager Warnke stated the County has done a wonderful job improving the Fairgrounds and asked about landscaping and improvements for the RV Park area. Commissioner Summers stated there will be open space with trees and a common area.

Commissioner Summers stated they have many people come off the freeway to use the County’s stalls just for overnight stay. County Building Official Codey Illum stated the only impact the City would probably have would be the sewer depending on seasonal use. Commissioner Summers stated as soon as this is up and running, there will be more baseball tournaments because participants could be right there by the ball diamond. Fair Board President Jan Rhodes stated there are only five hook-ups at the rodeo grounds right now and they always get asked by people to park there during ball tournaments.

Manager Warnke stated he has thought in the past about having a better connection between the Fairgrounds and the City Park. Commissioner Summers stated the County recently put in for the Safe Sidewalk Grant that would allow them to put in sidewalk on 1000 West to the park. Manager Warnke stated the City is also looking at improving the parking lot at the Recreation Office and potentially having one access to tie into 600 North. Chairman Bench clarified the City would like to make an intersection there. The Fairgrounds has more of a turn off than the Recreation Office so the City would move the access, line it up with 600 North, and put in curb and gutter into the Fairgrounds or the Recreation Office. Commissioner Summers stated he didn’t see a problem with doing that. President Rhodes stated it is rather complicated how the access is set up right now. Chairman Bench stated the City would have to move a power pole, phone box, hydrant, and other things that would need to be dealt with first.

Commissioner Summers stated the Bookmobile has also reached out to the County about housing their Bookmobiles at the Fairgrounds. Both the old cinderblock buildings at the Fairgrounds will be taken down and the new north building will be duplicated with the exception of the mezzanine, which will include more restrooms for fair time as well.

Commissioner Summers stated he would let the City know what he heard from the Shoshone Tribe about the RV Park.

Director Fulgham stated the City needs to come up with an ERU that fits an RV Park. RV Parks are kind of like hotels, but occupants will do some cooking in their RV’s. Chairman Bench stated it will depend on how elaborate the bathroom facilities are as well and if they include showers.
