Chairman Bench called the Land Use Authority Board Meeting to order at 9:10 a.m. The meeting was held October 4, 2017 in the City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Chairman Steve Bench, Engineer Chris Breinholt, Director Paul Fulgham, City Manager Shawn Warnke, and Deputy Recorder Cynthia Nelson were in attendance. Director Christensen was excused.

1. Approval of agenda:

Motion by Director Fulgham to approve the October 4, 2017 agenda. Motion seconded by Manager Warnke. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye, Manager Warnke – aye. Motion approved.

2. Approval of minutes—September 6, 2017

Director Fulgham had one correction. They talked about ped (pedestrian) pads in last week’s meeting, but it was written as peg and needs to be changed to ped.

Motion by Director Fulgham to approve the minutes of September 6, 2017 with the correction of the word peg to ped (page 1 item 3a). Motion seconded by Engineer Breinholt. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye, Manager Warnke – aye. Motion approved.

3. New Business:

a. Site Plan Review for T & M Expansion – Jim Flint

Administrator Bench asked about the pond. Mr. Flint said they originally thought it was 80,000 square feet, but it ended up being 161,000 square feet. That cost went up from $9,800 to 15,000 and will be was pretty expensive.

Mr. Flint said they need to make a note that the landscaping of the triangular piece will be changed from phase two to phase one. He added they are supposed to add a manhole intermediate on the irrigation. Manager Warnke asked if they are working on a landscape plan. Mr. Flint said Travis Scott has engaged an architect down in Salt Lake City to do the building, but is not sure on the landscaping of the triangular piece. He said he would look into that. Administrator Bench clarified the City does require a landscape architect to do the work.

Manager Warnke said the other thing on radar was the bond of public improvements. Mr. Flint said when we have a subdivision project that is one thing, but is it sort of self-enforcing on this? Although he said Mr. Scott does want to add those public improvements, he wondered about the timing and when they would be able to bond.

Administrator Bench then brought up the need to get things processed on the canal. Mr. Flint asked if it was just the portion under the canal or if they need the entire job. Manager Warnke clarified they need it separate so they can get the permit from the canal company. He asked Mr. Flint what the cost was. He said he has not seen it, but during a phone conversation they determined it would be about $80 a foot—the board itself is about 240 feet.

Mr. Flint then switched gears and talked about the Val Stokes’s subdivision, stating he has the map all done. Manager Warnke asked if they would be ready for approval of the preliminary final plat in the next meeting and Mr. Flint felt they would. Administrator Bench brought up fencing and the previous discussion of using trees and ground cover to help divide that. He asked if Mr. Stokes was going to talk to the homeowners to see what they thought and what needed to be done. Mr. Flint said he thinks they have met with them but is not sure what they plan to do. Right now a big section of that is filled with lilac bushes from the homeowner’s property. Administrator Bench said the problem with our code is it talks specifically about parking lots to property lines and there is a certain width based on landscaping and fencing. If you look at the ordinance it talks about landscaping and block wall—it is dual—it is both for the scope of work. Mr. Flint was not aware of this and they will look into it.

Administrator Bench took the discussion back to the T&M Expansion Site Plan. Mr. Flint said they will hire a landscape architect for that triangular piece and will get an estimate of those public improvements to the City. He asked does this count as a public improvement for this private water line or is it just the curb, gutter and sidewalk. Engineer Breinholt said the service that is metered counts (anything that is in the public right of way). Manager Warnke clarified that it is bonded because they are working in the public right of way for the improvements. He said ownership of that lateral is not necessarily the City’s and Engineer Breinholt said services are a requirement of development.

Engineer Breinholt asked how flat is it—how different is the elevation from the south end to the north end of the pond? Mr. Flint said he just kept it all the same and it was up about nine to ten inches. He explained that he kept the bottom of the pond 34 feet, but it could drop to 35 or 38 feet in some areas. He said the ground water is 40 feet deep so we tried to stay above it a few feet. He added they have about 40 different connections collecting all the returns and then discussed the piping.

Engineer Breinholt had nothing else to add, but brought up that they had talked about the piping of the ditch and if they would want a clean out box on it. Mr. Flint said they would get that on here.

The board thanked Mr. Flint for his work and then made a motion to approve.

Motion by Manager Warnke to approve phase one of the T&M Expansion. Motion seconded by Director Fulgham. Vote: Chairman Bench – aye, Engineer Breinholt – aye, Director Fulgham – aye, and Manager Warnke – aye. Motion approved.

Director Fulgham told Mr. Flint to let him know when they start landscape on the triangle piece of property so he can remove the other signage in the area and return it to the businesses. Manager Warnke said some of those would not be worth saving, but Director Fulgham wanted to avoid potential problems and make sure those businesses have that opportunity.

Manager Warnke asked about the architect working on the building at T&M. Mr. Flint said they have a good one from Salt Lake City—GSBS Architects. He said he has not seen any of the elevations views and is not sure how it will look at this time. He said I just go over what needs to be done to make sure it all works, but I think the footprint is reasonably locked in.

b. Walk ins:*

4. Comments/Reports:

Manager Warnke asked Administrator Bench if they are plugging away on code amendments and the flag lots. Administrator Bench said they should be caught up on everything and ready for the City Council meeting. Engineer Breinholt asked what they are changing. Administrator Bench said just some house keeping to make them more defined.

They discussed the upcoming Planning Commission meeting and having Manager Warnke and City Attorney Dustin Ericson in attendance to answer their questions on secondary water.

5. Public comments: Comments limited to five minutes.

6. Adjournment:

Motion by Manager Warnke to adjourn the meeting. Motion seconded by consensus of the Board. The meeting adjourned at 9:35 a.m.
