Acting Chairman Warnke called the Land Use Authority Board Meeting to order at 9:03 a.m. The meeting was held July 19, 2017 in the City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Acting Chairman Shawn Warnke, Engineer Chris Breinholt, Director Paul Fulgham, and Deputy Recorder Cynthia Nelson were in attendance. Chairman Steve Bench and Director Marc Christensen were excused.

1. Approval of agenda:

Motion by Director Fulgham to approve the July 19, 2017 agenda. Motion seconded by Engineer Breinholt. Vote: Acting Chairman Warnke – aye, Engineer Breinholt – aye, and Director Fulgham – aye. Motion approved.

2. Approval of minutes: June 21, 2017

Motion by Director Fulgham to approve the minutes of June 21, 2017. Motion seconded by Engineer Breinholt. Vote: Acting Chairman Warnke – aye, Engineer Breinholt – aye, and Director Fulgham – aye. Motion approved.

3. New Business:

a. Concept Review for two (2) lot subdivision – Ben Johnston

Manager Warnke expressed his concern about the number of lots that are starting to be developed in that area. However, he said Code does allow for four lots on a private drive.

Director Fulgham and Engineer Breinholt questioned if these homes would be able to connect to the sewer system, which is uphill from this location. They stated that the sewer will not make it up to 10th North at this time, but could with future development.

Lot one currently has a home and shed built on it. It is not hooked up to City water or the sewer system, but has a well and septic tank. The owners are hoping to subdivide lot two. The proposed home would sit on three-quarters of an acre. Director Fulgham asked if that was large enough for a septic tank. Engineer Breinholt said that would need to be addressed by the Bear River Health Department. Ben Johnston explained the County allows a septic tank on every 20,000 square feet. Director Fulgham clarified that would be okay as long as they have City water. Engineer Breinholt suggested adding the Bear River Health Department on the signature blocks of the plan.

Director Fulgham said their water meter will need to be within the City’s right-of-way at 10th North. They will also have to run a private service down that road or work out an easement with the property owner north of them.

The current lane is 12-feet wide. Since it serves more than two lots, it will need to be extended to 24-feet of paved/hard surface. Once it gets past the three homes, the lane can go back to 12-feet wide.

Manager Warnke asked about fire protection. It was determined a fire hydrant is located at the end of Country View near 10th North, but would be beyond fire code requirements. Engineer Breinholt said the fire code allows an average of 500-feet of spacing on their system, but more for structures (nearly 600-feet). Manager Warnke said when adding a compass on a hydrant and creating a circle, a large portion of the lot needs to be within that range. They agreed the area would exceed those recommendations.

Director Fulgham stated the homeowners would have to run 500-feet of 8-inch line and a hydrant. They are also responsible for the construction of the private lane and adding a water line along 3000 West. Engineer Breinholt suggested that if that road is dedicated, they need to include wording in the development agreement that the City is not going to maintain plowing or maintenance of it, except the water line.

It was clarified that even though 3000 West could be a dedicated roadway, it will continue to be treated as a private lane, which will allow four lots maximum, unimproved. Ben Johnston asked if the City would get involved in any of the construction. Manager Warnke said not unless there is a need for the City to create a connection further south. It is a matter of time and who is forcing development.

b. Walk ins:*

4. Comments/Reports:

Director Fulgham said he does not remember when Kirby’s was done and if it was done a different way or not. He said he should have had a hydrant, but it either did not come to the Land Use Authority Board or he doesn’t remember it. Manager Warnke said during the building permit process, the City should have required it. Engineer Breinholt said according to the fire code, his house was an okay distance from the fire hydrant, but this new house will not be.

5. Public comments: Comments limited to five minutes.

6. Adjournment:

Motion by Director Fulgham to adjourn the meeting. Motion seconded by consensus of the Board. The meeting adjourned at 9:42 a.m.
