Co-Chairman Greener called the Planning Commission Meeting to order at 5:32 p.m. The meeting was held May 28, 2019 in the City Council Meeting Room at 102 South Tremont Street, Tremonton, Utah. Co-Chairman Greener, Commission Members Bennett, Eberhard, Janssen, City Councilmember Rohde, Zoning Administrator Bench, and Deputy Recorder Nelson were in attendance.
1. Approval of agenda:
Motion by Commission Member Janssen to approve the May 28, 2019 agenda. Motion seconded by Commission Member Bennett. Vote: Co-Chairman Greener – aye, Commission Member Bennett – aye, Commission Member Eberhard – aye, Commission Member Janssen – aye. Motion approved.
2. Approval of minutes—May 14, 2019
Motion by Commission Member Bennett to approve the May 14, 2019 minutes. Motion seconded by Commission Member Eberhard. Vote: Co-Chairman Greener – aye, Commission Member Bennett – aye, Commission Member Eberhard – aye, Commission Member Janssen – aye. Motion approved.
Co-Chairman Greener called a Public Hearing to order at 5:33 p.m. to receive public input regarding proposed amendments. There was one person in attendance.
3. Public Hearing:
a. To receive public input regarding proposed amendments, Title I Zoning Ordinance amendments, Chapter 1.03 Definitions Automobile/Implement Sales Area; Chapter 1.08 Automobile/Implement Sales/Service as a permitted use and language corrections; Chapter 1.17 Off-Street Parking Regulations exempting Automobile/Implement sales area parking lots from landscape islands; Chapter 1.18 Landscaping, Buffering, and Fencing Regulations amending buffer widths between adjacent land uses and language corrections; Chapter 1.19 Supplementary Regulations relocating Towing and Impound Yards from Chapter 1.08. Title II Subdivision Ordinance amending language of Notary Acknowledgments, lots with double street frontage, and fencing from canals and railroad.
Administrator Bench said we added implement sales to the definition chapter. In Chapter 8, Commercial and Industrial Zone, there is one change and some house keeping. The automobile implement sales service was changed from a conditional use to a permitted use. We added wording that says for additional information you could see other chapters for supplementary information. The footnote numbering changed only because we took out the towing and temporary automobile sales lot—we moved it to the supplemental chapter. Councilmember Rohde asked about tattoos. Administrator Bench said it is still in there as a conditional use we just added a footnote to the supplementary chapter. Commission Member Bennett asked what the MDBP zone is, which is Manufacturing Distribution Business Park. That is where you took the conditional use away from the automobile implement sales and we cannot put one in that zone. Administrator Bench said right, they would be in the Commercial District, Commercial General, and Commercial Highway.
Administrator Bench said Chapter 17, Off-Street Parking, requires landscaping in parking lots. The change we added is in the automobile and implement sales area because their lot is a sales floor. Where the cars are for sale, they do not need the landscape islands. They will still need some in their general parking area and where cars are being repaired. Commission Member Eberhard wondered if Crump Reese Motors would have landscape to the south side of their fence next to the residential. Administrator Bench said it would be landscaped there.
Administrator Bench said we are moving towing and impound yards from Chapter 8 to Chapter 19. Commission Member Bennett confirmed there would still be the same provisions. We made some changes in Title II, the Subdivision chapter, and every now and again, we have to make sure the notary acknowledgments are proper. The City Attorney looked them over and made adjustments. There is more to come. We have some double frontage lots with a street in the front yard and a street in the back yard. This explains how to handle them. If the Planning Commission approves double frontage lots as part of their improvements, the developer shall install a privacy fence or wall along the rear lot lines abutting the rear street, which most of them have done.
Administrator Bench talked about fencing for major canals. We added in the rail corridor making sure there are fences when things are built next to the tracks (six feet high, seven feet maximum). In the Landscaping, Buffering, and Fencing chapter there is a lot of red. You can see the buffering widths and improvements from certain uses to other uses. We took out the confusing stuff, like some permitted use conditions, because 90% of the time that is done through the site plan permit process. Commission Member Bennett asked who provides the
20-foot buffer? Administrator Bench said the property being developed. We threw the canal, railroads, and double frontage lots in here as what the required improvement would be. These changes should make it easier to understand and follow.
There were no public comments. Co-Chairman Greener closed the Public Hearing at 5:48 p.m.
4. New Business:
a. Motion by Commission Member Eberhard to recommend the changes to the City Council. Motion seconded by Commission Member Bennett. Vote:
Co-Chairman Greener – aye, Commission Member Bennett – aye, Commission Member Eberhard – aye, Commission Member Janssen – aye. Motion approved.
b. Discussion of zoning change for Matt Ritter at approximately 565 West 600 South
Administrator Bench said there are six units and then it goes into single-family with a double frontage lot. It is zoned RM-7 right now, which is multi-family seven-units per acre. The other six buildings do not quite fit that zoning. Mr. Ritter is going to acquire that vacant parcel of property and develop a couple nice buildings. Mr. Ritter showed them a layout and different design options. Administrator Bench said he is looking at eight units, with two wide buildings on each side (two going north and two going south – each with a garage). Mr. Ritter said they would look like a duplex from the street, but they would be connected back to back more like a fourplex. Four would be accesses from each street, but they would be separate buildings. There is 20 feet from the property line, then the building, and then there is 25 feet between the next building with another 20 feet from the property line.
Commission Member Bennett said what does the zone need to be? Administrator Bench said to make that work and to bring the others into compliance it would be RM-16. The Commission asked about fencing and Mr. Ritter said he plans to do a vinyl fence down the east and west property lines and add some enhanced landscaping and design to the buildings. We would have the same amount like what is next door, but they would face a different direction and would look more like a townhome. Commission Member Bennett asked about parking. Administrator Bench said each unit would have a separate driveway and a garage with parking to the side. They will look like a single-family dwelling.
Commission Member Bennett said I do not see this going in the wrong direction. What is the next step? Administrator Bench said we would need to change the zoning. We just wanted to see if the Commission liked the idea. I will set a public hearing and then it will come back to you. The Commission advised Administrator Bench to move forward with a public hearing as long as there would be no issues with on-street parking.
5. Adjournment
Motion by Commission Member Bennett to adjourn the meeting. Motion seconded by consensus of the Board. The meeting adjourned at 6:02 p.m.
