Pursuant to Utah Code Ann. §§ 17C-5-110 and -205, notice is given that on January 16, 2024, the Tremonton City Council formally approved the Project Area Plan for the Autoliv Solar Community Reinvestment Project Area #1 by adoption of Ordinance No. 24-03. The Ordinance formally adopts the Plan for the Project Area and authorizes related actions by City staff and legal counsel. The Ordinance includes a map and a legal description of the land within the Project Area. Also adopted on January 16, 2024, were the following Interlocal Cooperation Agreements between the Tremonton City Redevelopment Agency and, respectively, the following taxing entities: (i) Tremonton City, and (ii) Box Elder County School District (each an “ILA”). Each ILA authorizes Agency to receive a portion of the respective taxing entity’s tax increment within the Project Area. The Ordinance, the ILAs, and the adopted Plan are available for inspection during regular business hours at the Tremonton City offices, 102 South Tremont Street, Tremonton, Utah. This notice is to be posted/published for a continuous period of 30 days (the “Publication Period”). The Plan and each ILA becomes effective at the end of the Publication Period. For a period of 30 days after the end of the Publication Period, any person in interest may contest the Plan or any ILA or the procedure used to adopt the Plan or any ILA if the Plan, ILA, or procedure fails to comply with applicable statutory requirements. After expiration of that 30-day period, no person may contest the Plan or any ILA or procedure used to adopt the Plan or ILA for any cause, nor may a person contest the distribution of tax increment to the Agency under either ILA or the Agency’s use of project area funds under the ILAs.
